1. Purpose and Scope

These Terms of Use (hereinafter "ToU") govern access to and use of the KantoBiz platform by bookers, meaning users searching for and booking artistic services.

1.1. Definitions

  • "Platform": the KantoBiz website and mobile applications
  • "Booker": any user registered as a client searching for artistic services
  • "Artist": any artistic service provider registered on the Platform
  • "Booking": the service request made by a Booker to an Artist

1.2. KantoBiz's Role

KantoBiz acts as a technical intermediary between Bookers and Artists. KantoBiz is in no way a party to the service contract concluded between the Booker and the Artist, nor an employer of the Artist.

2. Registration and Account

2.1. Registration Requirements

To register, the Booker must be at least 18 years old, provide accurate information, and accept these ToU and the Privacy Policy.

2.2. Account Security

The password must contain at least 8 characters including uppercase, lowercase, numbers and special characters. The Booker is responsible for the security of their credentials.

3. Bookings and Payments

3.1. Booking Process

The Booker may search for artists, view their profiles and send booking requests. The booking is confirmed when the Artist accepts the request and payment is completed.

3.2. Payment Methods

Payments are processed securely via Stripe. The following payment methods are accepted:

  • Credit/debit card (Visa, Mastercard, American Express) with 3D Secure authentication
  • Apple Pay (iOS)
  • Google Pay (Android)
  • PayPal (when available via Stripe)
  • Orange Money (authorized countries)

3.3. Service Fees

Service fees are charged in addition to the service amount. These fees cover the operation of the Platform and are non-refundable under any circumstances.

4. Cancellation and Refund Policy

Cancellation and refund conditions are defined at the time of booking and depend on the policy chosen by the Artist.

4.1. Flexible Policy

  • Cancellation more than 7 days before the event: full refund (excluding service fees)
  • Cancellation less than 7 days before the event: 50% refund (excluding service fees)

4.2. Strict Policy

  • Cancellation more than 7 days before the event: full refund (excluding service fees)
  • Cancellation less than 7 days before the event: no refund

4.3. Refund Timeline

Refunds are processed via Stripe to the original payment method. Processing time is 5 to 10 business days depending on your bank.

5. Communication with Artists

After a booking request is accepted, a messaging channel is opened between the Booker and the Artist. This channel allows the exchange of text messages (max 1,000 characters) and access to contractual documents.

6. Account Deletion

The Booker may delete their account from the application settings. Deletion is not possible if bookings are ongoing (status ACCEPTED or PAID). Deletion results in the permanent removal of all associated data.

7. Applicable Law

These ToU are governed by Malagasy law. For users residing in the European Union, the mandatory provisions of European consumer law apply. The European online dispute resolution platform is accessible at: https://ec.europa.eu/consumers/odr.
